At Enertium AI, we are dedicated to protecting your privacy and ensuring the security of your data. We will never re-identify anonymized data, and we understand the importance of maintaining a secure digital environment that uses privacy preserving technologies (PETs), is free from tampering, vendor backdoors, unnecessary cloud reliance, big data misuse, data resale and governmental interference; and that aligns with community expectations.

Storage and Security of your information

We take the security of your personal + sensitive information seriously and have implemented significant measures to protect it, both for our websites and our products. We store your information on secure servers and restrict access to those who need it for the purpose of providing you with our services. We also perform psychometric evaluations on anyone that we grant elevated access to personal or sensitive user information.

Headline Principles

For the data we store and/or process on your behalf as part of our products:

  • We believe in users first data privacy, where you are in control of where your personally identifiable and sensitive data goes and how it is shared. We do not support mass-surveillance, selling of data or covert search, seizure or take-over of user data by governments.

  • We do use aggressively anonymized 3rd party cookies and logfile storage, and 1st party logfile analysis on our websites and products for performance tuning, tracking advertising campaign conversions and measuring aggregate product use. This data is neither personally identifiable nor sensitive.

  • We do not and will not sell data, provide government access or provide backdoors for any of our products.

  • We do not adhere to any kind of warrant that does not come from a valid enforcement agency or that is associated with intelligence gathering, that names more than one individual party or that has not also been served on the individual.

  • We WILL provide valid enforcement agencies not associated with intelligence agencies with data and/or metadata in the case that a valid search and seizure warrant that names a single individual party is properly served on both us and the affected individual, and only then where the purpose relates to criminal investigations and does not involve intelligence gathering.

  • We do not provide data to enforcement agencies if it appears they are targeting a journalist, senior engineer, research scientist, entrepreneur, educator, defence attorney or intellectual property that:

    This is purely at our discretion, but we use the findings of judges provided in any warrants, as well as search-engine & public socials accessible:

    • educational background,
    • industry association membership,
    • compliance with ACM, IEEE and Operations Research codes of ethics & conduct,
    • open-source participation,
    • patent authorship,
    • academic and journalistic publication history & quality,
    • history of public speaking engagements,
    • company ownership, and
    • venture funding announcements
    to make this assessment.
  • We will endeavour to delete, anonymize and/or otherwise de-sensitize data stored and/or processed on your behalf at least 24 months after it is considered disused and no longer useful to you as a user.

  • We may absorb and mix some of your sensitive information into generative, descriptive and discriminative models as Training Data in such a way that it cannot be re-identified or reconstructed. This is a side effect of using AI, and helps to reduce false-positives and false-negatives and maintain model accuracy. We do this to constantly improve user experience when using our products.

    Whilst the Training Data might be deleted at least 24 months after it is considered disused and no longer useful to you as a user (per our policy above), portions of it that cannot be re-identified or reconstructed may remain in our models for much longer and cannot be deleted because it cannot be re-identified or reconstructed.

    We may also share these models between products, with other users & with third parties and mix it with theirs and other Training Data. This sharing is beneficial for user privacy when done at scale with users first privacy in mind. Users first privacy in this context means: models are designed and trained in such a way that ensures that no single user’s information can be re-identified or reconstructed as it would be computationally intractable to do so when mixed with a sufficient number of other users’ Training Data. Also, by absorbing Training Data into a model then deleting it, it reduces the attention we get from governments wanting your data.

  • We may sparingly use decision science, agent based reasoning and artificial intelligence to identify misuse or underperformance of our products in an automated manner. Where misuse or underperformance is detected, portions of personally identifiable and/or sensitive information may be sent to our system for review. Where possible, reviews are conducted by automated agents rather than human team members. Regardless of whether an automated agent or a human team member reviews the information, it will only be used for the purposes of deplatforming users or updating our models as Training Data, will never be passed onto third parties and is destroyed immediately after use.

Whilst we do strive to deliver on the above Headline Principles as part of our DNA, we may at times be prevented from doing so by technical or regulatory limitations. In such an event, we will strive to update Our Privacy First Policy where it is known and feasible to do so.

Specific Privacy Policy for SafetyGuard POC Beta Users

If you are currently participating in the Closed Beta of SafetyGuard, we have a SafetyGuard POC Privacy Policy for Testers which we are evolving so as to strike a balance between our own principles and those of 3rd party providers. Please read it in conjunction with this Privacy First Headline Principles as they both apply.

Once we move the app to general availability we will integrate both documents.

Where it is economically feasible, technically viable and does not cause significant additional carbon emissions or other ESG impacts as outlined in the UN Sustainable Development Goals, we will endeavour to migrate to and/or implement from the start, blockchain based decentralisation (web3) and privacy enhancing technologies (PETs) to implement these Headline Principles.

Information we collect from you

Like many other websites, we make use of log files to analyze trends, administer the site, track user's movement around the site, and gather demographic information. These log files do contain IP addresses.

How we use your information

We use the information we collect to analyze trends, administer the site, track user's movement, conduct anonymised A/B split tests and gather demographic information. This helps us improve our platform and provide you with a better user experience. We do not link this information to any personally identifiable or sensitive information.

Limited use of digital fingerprinting

We may use digital fingerprinting using fingerprint.js to detect when your user session cookie has changed computer, purely as a cyber-security tool to prevent subversion of MFA authentication. We will never use digital fingerprinting to subvert the intent of browser privacy settings, or to link up user sessions for our own gain. For example, using finterprint.js for tracking marketing pefomance is not the sort of use case we would participate in.

User Survey and Support Information

We may collect personally identifiable and sensitive information if you participate in a user survey or contact us with product inquiries such as technical support. In these cases, we only use the information for the purpose that it has been gathered for, as well as the collation of completely anonymous, de-identified and de-sensitised aggregate measures and summary statistics such as the number of inquiries received, the type of inquiry or response, and the number of inquiries resolved.

Cookies and Pixels

We may use cookies and pixels on our website to improve your browsing experience and provide you with personalized content.

Cookies are small text files that are stored on your device when you visit our website. Pixels are small images that are embedded in web pages, apps and emails. They can allow us to track your browsing behavior and provide you with personalized content.

We do not knowingly use cookies or pixels with any service that might utilize them for the direct sale of user data, governmental mass-surveillance, cross-site cookie exchanges or lookalike cookie pools. We also only use pixels that are wrapped in an iframe sandbox in the unlikely event that a service does attempt to utilize cookies from our websites for the purposes previously mentioned.

This section of our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use SafetyGuard POC (the "Service") for Android and tells You about Your privacy rights and how the law protects You. The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • Account means a unique account created for You to access our Service or parts of our Service.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

You can enable or disable access to this information at any time, through the Notification Settings in the app.

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Email address

  • Phone number

  • Usage Data

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may access, with Your prior permission:

  • Pictures, Audio and other information from your Device's camera, microphone & sensors but only for the purposes of transmitting messages to you. They are not collected or retained on our servers for any prolonged period outside of what is required to transmit them to you.
  • Write-only access to your Photo Library for the purposes of storing Pictures, Audio and other information from your Device's camera, microphone & sensors but only for the purposes of storing a historical archive of information transmitted to you. This data always remains local.
  • The above mentioned Picture, Audio & Sensor data but only for the purposes of synchronising this information with your other devices with SafetyGuard POC installed. They are not collected or retained on our servers for any prolonged period outside of what is required to transmit them to your other devices.
  • The geolocation & IP address of your device. This is only collected when you are sent notification messages, and is not stored on our servers - it is transmitted directly to you as part of the Notification Messages whenever an event is detected.

Suitable encryption is used as much as is practicably possible in the handling of this Information including (but not limited to) end-to-end encryption. An instance where it is not practicably possible to use end-to-end encryption is in the sending of email alerts, because of the inherent nature of how email works. We still use secure email protocols, to prevent eavesdropping on this Information when it is in transit.

We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.

Information Collected while Sending Email & Photo Stream Notifications via Google, Apple or Microsoft

SafetyGuard allows you to send a copy of all Notifications to a Google of Microsoft email address, including GMail, Google Workspaces, outlook.com & Office 365. Some capability to upload Notification photos to your albums may also be available to you depending on the version of Our Service you are running.

To enable or disable this, refer to the Notification Settings screen in the app.

Whilst these Notifications are encrypted in-transit to Google and Microsoft's servers (and only then at your discretion), please note that once they arrives at their servers the data is out of our hands and it is your responsibility to understand the associated Privacy, Data & Usage Policies associated with these services.

Further, the following assurances relate to our use of these APIs in delivering Our Service to you:

  • Google Email Delivery: Our App's use and transfer of information received from Google APIs adheres to Google API Services User Data Policy, including the Limited Use requirements.
  • Microsoft: No additional requirements at this stage. Please refer to Microsoft's website.
  • Apple: No additional requirements at this stage. Please refer to Apple's website.

Information Collected for Training AI Models

Given the sensitive and/or classified nature of the data that SafetyGuard has access to, as design principles:

  • The SafetyGuard app never continuously records or streams live video or audio. It may store small clips to your device's local storage, but the only video that ever leaves the device are individual key frame photos as sent directly to you from the device via the Notification Messages.
  • We do not have access to Notification Messages and associated key frame photos as they are delivered directly (i.e. do not pass through our servers) and are end-to-end encrypted and/or encrypted-in-transit depending on which Notification Settings you have enabled.
  • Enertium AI DOES NOT collect any of your data for training of models. Instead we use our own data, publicly available open source data & academically available research datasets to train & evaluate all our computer vision, machine learning and AI.

We may in future allow users to submit small clips of training data where the app has not performed well, but this will be solely at your discretion to opt-in to this capability each and every time and this will be made clear in the app if and when those features are added.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.

  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.

  • To manage Your requests: To attend and manage Your requests to Us.

  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

We may share Your personal information in the following situations:

  • With Service Providers: We may share Your personal information with Service Providers to operate, monitor and analyze the use of our Service, and to contact You. In all instances where this occurs, this will be made clearly apparent.

Retention of Your Personal Data

Updates to Our Privacy First Policy

If we store data on your behalf as part of our products, you have registered with and are an active user of our Enertium GuardDuty product, and you are affected by an update to Our Privacy First Policy, then you will be notified by email if and when Our Privacy First Policy changes.

We reserve the right to reduce our minimum data retention period below 24 months and to purge data without first notifying users or updating Our Privacy First Policy, if we believe there is an immediate material risk of governmental agencies targeting our systems.
